1. Introduction

AclarisAI is an AI-powered clinical documentation platform operated by Aclaris Health LLC. By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Subscription & Billing

New users receive a 14-day free trial. No credit card is required to start the trial.
Paid plans begin automatically at the end of the trial period unless cancelled before the trial ends.
All payments are non-refundable. We do not provide refunds for partial billing periods or unused time.
Annual plans are billed upfront and provide a 15% discount compared to monthly billing.
Prices are subject to change. We will provide at least 30 days notice of any price change affecting your subscription.

3. Acceptable Use

The Service is intended exclusively for licensed healthcare professionals in connection with their clinical practice.

AclarisAI is a documentation aid and is not a substitute for clinical judgment, diagnosis, or patient care.
You may not use the Service for non-clinical purposes, unlawful activity, or in any manner that violates applicable healthcare regulations.
You are responsible for reviewing all AI-generated content for accuracy before incorporating it into a patient's medical record.

4. Data & Privacy

Protected Health Information (PHI) and other user data are handled in accordance with our Privacy Policy.

Auto-save is OFF by default. Notes are not stored server-side unless you explicitly save them.
You retain control over the storage, retention, and deletion of your notes.
For enterprise or institutional use involving PHI, a Business Associate Agreement (BAA) is required.

5. De-identified Data

De-identified and aggregated data generated through use of the Service, which does not identify any individual patient or user, may be retained and used by Aclaris Health LLC for product improvement, research, and analytics purposes. All de-identification is performed in accordance with applicable law, including HIPAA where applicable. Aclaris Health LLC retains ownership of all de-identified and aggregated datasets derived from use of the Service.

6. Intellectual Property

AclarisAI and all associated technology, software, algorithms, models, branding, and content are the exclusive property of Aclaris Health LLC and are protected by applicable intellectual property laws. No license or right to any Aclaris Health LLC intellectual property is granted except as expressly set forth in these Terms.

You retain ownership of the clinical content you generate using the Service.

7. Disclaimer & Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied.

Aclaris Health LLC is not liable for any clinical decisions, diagnoses, or patient outcomes resulting from content generated by, or actions taken in reliance on, the Service. You are solely responsible for the accuracy and appropriateness of any AI-generated documentation.

To the maximum extent permitted by law, the total aggregate liability of Aclaris Health LLC arising out of or relating to the Service shall not exceed the fees paid by you to Aclaris Health LLC in the three (3) months immediately preceding the event giving rise to the claim.

8. Termination

Aclaris Health LLC may suspend or terminate your account, at its sole discretion and without prior notice, for any violation of these Terms or for conduct that we determine to be harmful to the Service, to other users, or to Aclaris Health LLC. You may cancel your account at any time through the application.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.
